On January 31, 2011, Elizabeth Branham appeared before El Paso's City Council. She told the Council that the last time she appeared before the Council, Mayor Cook wrongly cut her off and told her to take her freedom of speech outside. She also told them that Cook had wrongly sued her in an attempt to deny her right to petition the government, her civic duty. Cook present at the Council meeting was mute this time. Mayor Cook repudiated and nullified an ordinance passed by a large majority of the citizens of El Paso. Like a dictator, he trampled upon the will and votes of his own citizenry. Over 15.000 recall signatures were gather and turned into the City Clerk who certified them as being adequate for a recall election. The Governor issued an order permitting a special recall election to be held on April 14, 2012. In the meantime Cook filed suit against a church, a specific purpose committee, the El Paso City Clerk and three individuals in an attempt to first stop the recall petition drive, second to stop the recall election and lastly to invalidate the recall petitions and recall election. Many have described this action by Cook as a fishing expedition, a shotgun approach and harassment. The court claims by Cook have been directed mainly against the Church and to a lesser degree against the specific purpose committee.
